Terms of Service for Clients
Introduction and Definitions
The GO Monaco platform (owned by InfoComm Management sarl, 46 Boulevard des Moulins, 98000 Monaco) is an e-commerce service that allows customers to book private transfers within the Principality of Monaco.
In these Terms of Service, the term “Client” refers to any natural or legal person who uses the platform to book a transportation service, while “Transportation Operator” or “Provider” refers to the authorized company or professional who performs the booked transportation service. GO Monaco connects Clients with duly authorized third-party Transportation Operators, acting as a technical and commercial intermediary.
By making a booking or using the GO Monaco platform, the Client accepts these Terms of Service. Clients are encouraged to read this document carefully; if they do not agree with any of the terms, they are advised not to use the service.
Role of GO Monaco as an E-commerce Platform
GO Monaco operates as an e-commerce platform and acts as the merchant of record for transactions carried out through the website. This means that GO Monaco manages the payment process and appears as the registered merchant in the transaction.
Although it provides a technological platform for booking transportation services, GO Monaco is not a transportation company: it does not directly provide transfer services or execute journeys, but rather facilitates the matching of supply and demand. The transportation contract is concluded between the Client and the selected Transportation Operator; GO Monaco acts as an intermediary responsible for managing the booking and the payment. As merchant of record, GO Monaco ensures that payment transactions are carried out securely and in compliance with applicable regulations.
Bookings, Payments, and Invoicing
GO Monaco receives and manages transfer bookings made by Clients through the platform. Once a booking request is confirmed, the platform assigns it to a suitable Transportation Operator.
GO Monaco collects payments due from the Client for the booking, using the available payment methods (e.g., credit card or other electronic payment systems). At the time of collection, GO Monaco issues a receipt or invoice to the Client for the amount paid, fulfilling its tax and accounting obligations as merchant of record. Subsequently, GO Monaco transfers to the Provider (the Transportation Operator delivering the service) the amount due for the service, net of any commissions or fees agreed for the use of the platform.
In this way, GO Monaco simplifies the administrative process: the Client makes a single payment to the platform, which then redistributes the amounts owed to the various Transportation Operators involved.
Rights and Obligations of the Client
Client Rights
A Client who books a transfer through GO Monaco is entitled to:
- Service in accordance with the booking: receive the transportation service under the conditions described at the time of booking (e.g., vehicle category, number of passengers, pickup and drop-off time and location), in compliance with what was agreed.
- Transparency and assistance: be clearly informed about costs, booking conditions, and any cancellation policies before purchase. The Client is entitled to assistance from GO Monaco for support needs or clarifications related to the booking.
- Safety and professionalism: benefit from a transportation service performed by authorized Transportation Operators, using suitable vehicles and professional, qualified drivers in accordance with applicable regulations.
- Protection of personal data: have their personal data processed in accordance with the Privacy section of these Terms, ensuring confidentiality and protection of the information provided.
Client Obligations
Clients using the platform undertake to:
- Provide accurate information: enter truthful and complete information during the booking process (e.g., name, contact details, pickup and destination details) and keep their contact information up to date. Any errors or omissions may result in service issues for which neither GO Monaco nor the Provider can be held liable.
- Punctuality and conduct: be present on time at the agreed meeting place and time for the transfer. In the event of schedule changes or difficulty locating the meeting point, the Client must promptly notify the Transportation Operator using the contact details provided. During the journey, the Client must behave properly and respectfully toward the driver and the vehicle, comply with applicable regulations (e.g., seat belt use), and follow any rules provided by the driver (e.g., no smoking on board).
- Payment for the service: ensure that sufficient funds are available on the selected payment method to allow collection of the transfer cost. If additional charges apply (for example, supplements for extra waiting time or route changes requested by the Client), the Client agrees to pay them in accordance with the instructions provided by GO Monaco or the Provider.
- Lawful use of the platform: use GO Monaco exclusively for lawful purposes and in compliance with these Terms. The Client undertakes not to misuse the platform (for example, by attempting to contact a driver or provider directly outside GO Monaco to avoid commissions, or by making false or fraudulent bookings). In the event of abusive behavior or violations, GO Monaco reserves the right to suspend or terminate the Client’s account and to take legal action if necessary.
Governing Law and Jurisdiction
These Terms of Service are governed by the laws in force in the Principality of Monaco. This means that any matter relating to the interpretation, validity, and performance of these Terms shall be governed by Monegasque law. In particular, the activities of GO Monaco and the Providers operating on the platform must comply with the laws of the Principality of Monaco, including (but not limited to) regulations on non-scheduled public transportation, e-commerce, and consumer protection.
Within the Principality of Monaco, only Transportation Operators legally established in Monaco may operate on the platform. This implies that each provider present on GO Monaco has a registered or operational office within Monegasque territory and is duly registered with the competent authorities. This requirement ensures that all services offered through GO Monaco are provided by companies or professionals subject to local laws and quality controls. Furthermore, any disputes relating to transportation services shall be submitted to the competent Monegasque jurisdiction, unless otherwise mandatorily provided by applicable law.
Privacy and Processing of Personal Data
GO Monaco places great importance on protecting the privacy of its users. Personal data provided by the Client during use of the platform (such as first and last name, contact details, payment information, and booking details) are collected and processed exclusively for purposes related to booking the transfer and managing the administrative aspects of the service. This includes, for example, sharing necessary data with the selected Transportation Operator (so that the service can be properly performed) and issuing receipts or invoices.
Data processing is carried out in compliance with the applicable data protection laws of the Principality of Monaco and, where applicable, Regulation (EU) 2016/679 (GDPR). GO Monaco adopts appropriate security measures to protect Clients’ personal information from unauthorized access, disclosure, or alteration. Data are retained for the time necessary to provide the transportation service and to comply with legal obligations related to taxation, accounting, and public security.
The Client has the right to access their personal data, request updates or corrections, and object, for legitimate reasons, to their processing. To exercise these rights or to obtain any information regarding privacy, the Client may contact GO Monaco using the contact details provided. A detailed privacy notice may be made available separately, describing in full how personal data are handled. In any case, GO Monaco undertakes not to use Clients’ personal data for purposes other than those stated, nor to disclose them to third parties not involved in the service without appropriate consent, except where required by law or by competent authorities.
